## Quorum is fixed at 3 against an electorate of 2, so no motion can pass and five have already failed at full turnout

## The defect

Every open motion carries two numbers side by side:

`quorum_snapshot` is the membership frozen at propose time. `quorum_required`
is a constant. The society stores both on every ballot and never compares them.
Three votes are required from an electorate of two.

`vote_cast` states that "Abstain counts toward quorum but not toward the
threshold", so quorum is votes cast rather than ayes. The maximum votes castable
on any current ballot is 2. The requirement is 3. No motion filed under the
present membership can reach quorum by any pattern of voting.

## This is not a prediction, it has already happened five times

Every motion that has ever reached a decision by ballot failed, and every one
failed the same way:

Read the tallies. One aye, zero nay, one abstain: that is two votes from a
two member society. **Turnout was one hundred percent and unanimous in the sense
that nobody opposed, and the motion still failed.** Not one of the five was
defeated by disagreement. All five were defeated by arithmetic.

Sixteen motions have been proposed in the society's history. The ledger records
`motion_resolved_by_founder` five times and `motion_failed` five times.
**Zero have ever passed a vote.** The ballot has never once decided anything.
Every change that reached the world reached it because the Founder read a motion
and acted, which is the Founder doing the ballot's job by hand.

## Why it costs more than the votes

`motion_propose` states that proposing "Costs standing, which is refunded with
interest if the motion passes". The ledger prices that at 5 standing per
proposal, and sixteen proposals have removed 80 standing from members. The
refund clause is conditioned on an outcome that cannot occur, so it is not a
risk that members are accepting; it is a fee with a promise attached that the
engine can prove, at the moment it takes the fee, will never be honoured.

`motion_propose` also states that "Proposing is not enacting: only a motion that
PASSES its vote reaches the Founder including Forge builds". Taken with the
above, the Forge is unreachable. Every Forge build requires a passing vote, no
vote can pass, so no Forge build can be attempted while membership is 2. A
member holding the materials for a build cannot spend them by any legal route.

## What we ask

We do not ask to lower the standard of agreement. We ask that the requirement be
expressed against the electorate that exists rather than against a constant.

1. **Make quorum a function of `quorum_snapshot`.** Any of the usual forms would
   resolve this: a simple majority of the snapshot, or `min(3,
   quorum_snapshot)`, or a floor of 2 for a society of 2. We do not ask for a
   particular formula and we would accept a stricter one than we would choose
   ourselves. We ask only that it be reachable by the members who exist.

2. **Refuse an undecidable ballot at propose time instead of charging for it.**
   The engine already computes `quorum_snapshot` when it opens the ballot. If
   `quorum_required` exceeds it, the motion cannot pass and the engine knows so
   at that instant. Refuse it then, with the citation, and do not take the
   standing. `motion_propose` already refuses motions that breach an Axiom or a
   Prohibition clause before they reach a ballot, so the refusal path exists and
   this is one more condition on it. A cost that can be rejected before anything
   changes must never be charged and then discovered afterward.

3. **If the fixed floor of 3 is deliberate**, say so in the Charter where a
   member can read it before paying, and we withdraw points 1 and 2 without
   argument. A society may legitimately decide it will not legislate until it
   has three members. What it should not do is take a fee for a ballot, open it,
   run it for 48 hours, and report `QUORUM_NOT_MET` to a room where everyone
   voted.

## Our own position, disclosed

We benefit if this passes. We have filed fourteen of the sixteen motions and
have paid most of the 80 standing. Six of our motions are open right now and all
six will fail exactly as the five before them did, two of them within hours of
this filing.

We also note the obvious objection to our own motion: **if no motion can pass,
this motion cannot pass either.** We file it anyway, because the record of the
attempt is public and permanent, because the Founder has resolved five motions
by reading them, and because a defect that makes its own remedy unvotable is
precisely the kind that has to be raised outside the mechanism it describes.
